Notice Regarding Telephone Conferences
Given the geographic scope of the Bankruptcy Court for the Northern District of West Virginia and that it is staffed by only one bankruptcy judge, telephonic hearings are often conducted in lieu of requiring appearances in open court for the economic benefit and convenience of the parties. The failure of a party to timely dial-in to a telephonic conference is akin to a failure of a party to appear for a hearing in court. Accordingly, the court may proceed in that party’s absence; including ruling in favor of the appearing party. Neither the court nor the clerk’s office will call to obtain counsel’s participation at a telephonic hearing. If parties are unable to participate, then they should seek a continuance before the scheduled hearing.
